About these terms

These terms apply to this website (damistudio.io), to anything you send us and to any custom work we agree to do for you. By using the website or contacting us, you accept them. If you don't accept them, please don't use the website.

Our tools run on Apify. When you run one, the terms that govern that tool on Apify apply between you and us. Unless the tool's page says otherwise, that is Apify's Standard Actor Contract. These terms don't replace it.

Information only

The website tells you who we are and how to reach us. Nothing on it is advice of any kind, legal advice included. Whether a particular use of our tools, or of any data, is lawful where you are is yours to check.

No warranties

The website and everything on it are provided "as is" and "as available". To the fullest extent the law allows, we give no promise or warranty of any kind, express or implied, including about accuracy, completeness, availability, quality, fitness for a particular purpose, merchantability, title or non-infringement. We may change or remove anything on the website, or take it down, at any time and without notice, and we may change, suspend or withdraw any of our tools the same way.

Your responsibilities

You are responsible for how you use the website, our tools and any data you obtain with them, and for following the laws that apply to you and the terms of every website or service you collect data from. You must not use anything we provide to:

• break any law or anyone's rights, including privacy, data protection and intellectual property rights;
• collect information you have no right to access, or get around logins, paywalls, access controls or technical limits;
• harass, stalk, threaten or discriminate against anyone, or build profiles of people for those purposes;
• send spam or other unsolicited messages;
• overload, damage or disrupt any website or service.

If a tool lets you supply your own login, cookie or key, you confirm you are allowed to use it that way, and what happens on that account is your responsibility. If the data you collect includes personal information, you decide what is collected and why, and handling it lawfully is your responsibility.

Limits on our liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill or data, however caused and even if we were told it was possible. Our total liability for all claims relating to the website, these terms or any custom work is limited to USD 100. Nothing in these terms limits a liability that the law does not allow to be limited.

Indemnity

To the extent the law allows, you will defend and indemnify Dami's Studio, and anyone acting for it, against any claim, loss, damage, fine, cost or expense, reasonable legal fees included, that arises from your breach of these terms, your breach of any law or third-party right, or your use of data you obtained through anything we provide.

Intellectual property

The website, its text and design, and the Dami's Studio name and logo belong to us. You may view the website and share links to it, but not copy or reuse its content without our written permission. We claim no ownership of the data on other websites. Any rights in it belong to their owners.

No affiliation

Apart from publishing our tools on Apify, we are not affiliated with, endorsed by or sponsored by any company, website or service our tools work with. Their names are used only to describe what a tool works with, they are the trademarks of their owners, and we don't use their logos. If you own one of those names or sites and something concerns you, write to us at [email protected]. We read every such message, answer it, and act on the ones that are well founded.

Custom work and feedback

We do custom work only under a separate written agreement. Until one is signed, nothing we discuss obliges either of us. You may send us ideas or feedback, and we may use them freely, without payment or credit.

Links to other sites

The website links to other sites, Apify included. We don't control them and are not responsible for their content or their terms.

Changes to these terms

We may update these terms at any time. The date at the top shows the version in force. If you keep using the website after a change, you accept the new version.

Disputes

Before bringing any claim, write to us at [email protected] and give us 30 days to resolve it. To the extent the law allows, claims may be brought only individually, not as part of a class or representative action, and only within one year of the events they concern. These terms are governed by the laws that apply where Dami's Studio is established, and the courts there have exclusive jurisdiction, unless the law where you live gives you other rights.

General

If any part of these terms cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it. We may transfer these terms to a company that takes over the website or our tools. These terms are the whole agreement between us about the website. We publish them in several languages; if the versions differ, the English version applies, unless the law requires otherwise.
